Internal Order: Defining the Support of the Armed Forces to the National Police

Abstract

After a brief description of the concepts of internal order, public order and citizen security, a distinction was made as to their scope, limits, principles and responsible entities. To this end, an exhaustive comparative analysis was made of Legislative Decree 1095, which “establishes rules for the employment and use of force by the Armed Forces in the National Territory, and Legislative Decree 1086, which “regulates the use of force by the National Police of Peru”. The importance of their compliance in the different risk scenarios by both institutions was determined, describing the gradualness and intensity of the use of force in the face of threats in the management of internal order. In this context, gaps and opportunities for improvement were identified with respect to the definition of the support provided by the Armed Forces to the Peruvian National Police (PNP) in the aforementioned management. Finally, recommendations are proposed that include the use of military capabilities to support the process of police operations, revision of regulations, capacity building, among others.

  • Emilio Jesús Cam Albújar, Peruvian Army, Ejército del Perú

    Emilio Jesús Cam Albújar is a Colonel of Artillery of the Peruvian Army (EP), with a bachelor’s degree in Military Sciences with a major in Engineering from the Military School of Chorrillos. He holds a Master’s Degree in Military Sciences from the Army War College (ESGE) and a Master’s Degree in Management and Technological Innovation from the Scientific and Technological Institute of the Army (ICTE), as well as a Master’s Degree in Security and National Defense from the Center for Higher National Studies (CAEN). He has specialized studies in Management Skills and Competences Development, Strategic Human Resources Management and Logistics Supply Chain Management at ESAN University. He took the following courses: Strategic Intelligence at the National Intelligence School (ENI), International Relations and Foreign Policy of Peru at the Diplomatic Academy of Peru, and Psychological Operations at the School of Psychological Operations (OPSIC). He participated in the course “Ethics, Integrity and the Military Profession Workshop” at the College Militaire Royal de Saint Jean, as well as in the Specialization Program in Strategic Planning at the Universidad del Pacífico (UP). Additionally, he obtained a diploma in Competency-Based Learning at Marcellin Champagnat University and completed the course Strategic Direction for Defense and Crisis Management (CEDEYAC) at the Superior School of Naval Warfare (ESUP). Currently, he teaches at the ESGE and is the head of Personnel Rights of the EP.
